			<description><![CDATA[<p>Creating a Will is crucial to ensuring your wishes are upheld and your family is provided for when you pass away. Usually, there is a significant period of time between creating a Will and your estate being passed on, which means that circumstances can change and life events can occur which can alter its validity or mean that you need to update it.</p>
<p>In this blog, Kacy Porter, trainee solicitor, outlines six events which could impact your Will and highlights the importance of reviewing it regularly to ensure it continues to reflect your current wishes.</p>
<p><strong>Getting married or entering a civil partnership </strong></p>
<p>In England, Wales and Northern Ireland, getting married automatically invalidates any Will that you may have previously made. The only exception to this is if your Will was explicitly made in contemplation of the marriage.</p>
<p>Whilst it may not be a top priority for newlyweds, it is advisable to create a new Will as soon as possible after marriage to ensure your new wishes are in writing. Alternatively, engaged couples can make a Will in contemplation of marriage, so that it does not become void and there is no time period in which their wishes are not protected.</p>
<p>If you do not create a new Will, the original beneficiaries (individuals due to receive gifts) could be left with nothing if you pass away. The law will decide who inherits your estate under intestacy rules.</p>
<p><strong>Divorce or dissolution of marriage </strong></p>
<p>Whilst divorce does not fully revoke your Will, it does invalidate any gifts to your former spouse – they will no longer be able to benefit from your Will or act as an executor or trustee. This means that if your spouse was the sole beneficiary named in your Will, they will be treated as though they have died and the law will decide how the estate is distributed.</p>
<p>It’s important to note that a separation does not have the same impact on a Will as a divorce. If you are separated, your spouse is still entitled to inherit whatever is detailed in your existing Will.</p>
<p>As a result, updating your Will following either a divorce or separation is crucial to ensuring that your estate is passed on to the right people.</p>
<p><strong>Death of a beneficiary or executor </strong></p>
<p>Following the loss of a loved one, updating your Will is unlikely to be front of mind. However, if this loved one was a beneficiary and/or executor of your Will, you will need to make changes to ensure your wishes are upheld. If an executor passes away before you, you can appoint a new executor and update your existing Will accordingly. You can appoint up to four executors in your Will and it is a good idea to have more than one, should this circumstance arise. If you were to die without an executor, your estate would go through probate.</p>
<p>Should a beneficiary pass away, their gift usually becomes void and their share is redistributed to the remaining beneficiaries. You can update your Will to redirect the share, or you can leave instructions within it (a substitution clause) to say where you would like the gift to go in the event that a beneficiary dies. If a child dies before receiving the inheritance left to them by their parent, it may be passed on to the child’s surviving children.</p>
<p><strong>Moving abroad or owning overseas assets </strong></p>
<p>Different countries have different laws, meaning that a Will made in the UK may not be valid overseas. If you move abroad or purchase a property in a different country, you may need separate Wills to protect your assets in multiple jurisdictions. For example, in some countries, there are heirship laws which require you to leave a percentage of your assets to protected heirs, such as your spouse or children. A UK Will may not align with these rules, causing issues if you would like to distribute your assets to others.&nbsp;</p>
<p>Whether your Will is valid overseas depends on a variety of factors, including the laws and inheritance rules of specific countries, meaning that specialist legal advice is required to ensure all assets are covered.</p>
<p><strong>Birth of a child or grandchild </strong></p>
<p>The arrival of a new addition to the family is the perfect opportunity to review your Will. Although a child or grandchild won’t have any automatic impact on your Will, you may wish to add them as a beneficiary or reconsider how your assets will be divided now that there is another family member to consider. You can also nominate who you would like to care for your child or children in the event of your passing, by appointing a guardian who is named in the Will.</p>
<p><strong>Change in financial circumstances </strong></p>
<p>Whilst a change in wealth will not invalidate your Will, a significant boost from inheritance, selling a business or winning the lottery does warrant a review of what your beneficiaries will receive. There may also be inheritance tax implementations associated with the increased estate value, prompting a review of tax planning strategies.</p>
<p>On the other hand, if your level of wealth reduces, or you sell an asset which you intended to gift to a beneficiary, these changes will need to be reflected in an updated Will.</p>
<p><strong>Protecting your wishes </strong></p>
<p>Amidst significant life events like marriage, divorce or the loss of a loved one, reviewing and updating your Will can easily be forgotten. However, these changes can have a significant impact on whether or not your wishes are upheld when you pass away. Taking the time to ensure your Will evolves with you means that your loved ones will receive what you wish them to when the time comes.</p>

			<description><![CDATA[<p>If you’ve been thinking about starting the search for your first home, this year could be a prime opportunity to get on the property ladder. First-time buyers currently have a growing number of low-deposit mortgages to choose from, alongside schemes to support them in taking the next step.</p>
<p>Purchasing your first property is exciting, but it can also feel daunting. There are significant, hard-saved sums of money involved, and lots of jargon when it comes to the paperwork, meaning many first-time buyers are unclear on the process and can skip over important considerations when purchasing their first home.</p>
<p>Here, our trainee solicitor Charles Barrand outlines three factors for first-time buyers to consider and breaks down some terms that can often cause confusion.</p>
<p><strong>Leasehold or freehold – what’s the difference? </strong></p>
<p>When searching for a property, it’s important to be clear on the difference between leasehold and freehold. A freehold means you own the property and land outright and indefinitely. With a leasehold, you own it for a fixed period of time and a freeholder owns the land. Many flats are leasehold, with annual service charges and ground rent payable to the owner of the building the apartment is in. A lot of houses are freehold, but this isn’t always the case.</p>
<p>Before purchasing a leasehold property, make sure that you’ve accounted for any additional charges, any future increases, and considered how many years are left on the lease. Often, a leasehold will be anywhere from 90 to 999 years, so it’s unlikely to end during the time you live in the property, but it’s always important to make sure, as it can impact your mortgage and the resale value. If you’re planning to make any significant changes to the property, you’ll usually need the landlord’s permission.</p>
<p><strong>Legal ownership: joint tenants vs tenants in common </strong></p>
<p>Another key consideration for any buyer is how the property will be owned. As joint tenants, you own the whole property together, which means that if it’s sold, both owners receive an equal share. Under a joint tenancy, if the co-owner passes away, their interest in the property automatically transfers to the surviving co-owner. As a result, this form of ownership is common with spouses and long-term partners, as well as those contributing equally to the property purchase.</p>
<p>Alternatively, tenants in common own individual, unequal shares of the property. This is often preferred by siblings, business partners or friends purchasing a property together, or by those who want to protect their individual financial contribution. If you and your co-purchaser are contributing unequally to the deposit, this should be recorded in a legal deed called a Declaration of Trust, which your solicitor can prepare at the time of purchase.</p>
<p>As tenants in common, each owner’s share of the property forms part of their estate and passes in accordance with their Will; it doesn’t automatically transfer to the co-owner.</p>

<p><strong>Financing your purchase: ensuring you can cover the costs </strong></p>
<p>Many first-time buyers use Help to Buy or Lifetime ISAs to boost their deposits and benefit from the additional government contributions. However, they do make the process more complex and time-consuming, which is reflected in a small increase in the legal fees.</p>
<p>Other circumstances, such as buying a leasehold property or requiring a Declaration of Trust, can also increase legal costs, so ensure that you have budgeted for these before making the decision to move forward with your house purchase. Additionally, the conveyancing process for a new build property can differ significantly, due to additional checks, developer involvement and tighter timelines, which can incur higher costs.</p>
<p>Whilst reaching your deposit goal is a major milestone, it’s also important to account for costs associated with surveys, mortgage fees (if applicable), moving and insurance, alongside conveyancing costs, to ensure you have enough left over to cover these expenses. First-time buyers in England don’t pay Stamp Duty on homes up to £300,000, but if the property you’re purchasing is over this amount (up to £500,000), you’ll need to pay a reduced rate of 5%. If the property is over £500,000, you won’t qualify for first-time buyers’ relief.</p>

<p>In many marriages, finances are divided along practical lines and one spouse may not have full visibility of everything. That is particularly common where there are business interests, trusts or substantial investments. Getting clarity early helps avoid unpleasant surprises later and allows sensible decisions to be made from an informed position.</p>
<p>Speaking to a family solicitor at this stage is not a commitment to divorce. It is simply a way of understanding where you stand, what a fair outcome might look like and how the process usually unfolds if you decide to proceed.</p>

In the England and Wales, property can be owned as either joint tenants or tenants in common.&nbsp;</p>
<p>Both types of property ownership have distinct legal and practical consequences, especially when it comes to future finances, inheritance, and flexibility. Choosing the right type of ownership at the outset can help avoid future disputes or complications and ensure your wishes are followed.</p>
<p><strong>Joint Tenants</strong></p>
<p>Under a joint tenancy, all owners are considered to own the whole property together, rather than holding individual and defined shares. This is the case even if one party has contributed more to the purchase price. Therefore, on sale it is presumed that each owner will receive an equal share.</p>
<p>Another important implication of joint tenancy is the right of survivorship. This means that if one co-owner passes away, their interest in the property automatically transfers to the surviving co-owner(s). This arrangement can simplify inheritance matters, as the property passes directly to the surviving owner(s). However, it also removes the ability to leave your share of the property to someone else in your will.&nbsp;</p>

<p>By contrast, a tenancy in common provides greater flexibility. Under a tenancy in common, each co-owner can hold a distinct and potentially unequal share of the property. For example, one owner may hold 70% while the other holds 30%.&nbsp;&nbsp;</p>
<p>Where purchasers are contributing unequally, it is often appropriate to record the ownership proportions in a Declaration of Trust, which is a legal deed prepared at the time of purchase.</p>
<p>Unlike joint tenancy, there is no right&nbsp;of survivorship where the property is held as tenants in common. Instead, each owner’s share will form part of their estate and passes according to their will or, if no will exists, under the rules of intestacy. This allows co-owners the ability to make provision for the share of the property they hold in their will, offering more freedom in estate planning.</p>
<p>Tenancy in common is often preferred by purchasers who are friends, siblings, or business partners buying property together, as well as by individuals who want their financial contributions clearly reflected in ownership shares.</p>
<p><strong>Things to Consider Before Deciding</strong></p>
<p>When deciding which ownership type is right for you, it is important to think carefully about your circumstances and long-term plans:</p>

<p><strong><span style="color: #000000;">Step 1: Instruction</span></strong></p>
<p><span style="color: #000000;">The process begins when you instruct a firm of solicitors to represent you and to handle all the legal aspects of the property transaction on your behalf.</span></p>
<p><strong><span style="color: #000000;">Step 2: Contract Review</span></strong></p>
<p><span style="color: #000000;">Once your conveyancer receives the contract and title deeds from the seller’s solicitor, they will examine them to ensure they are in order, that your interests are protected, and to identify any questions that need to be raised.</span></p>
<p><strong><span style="color: #000000;">Step 3: Property and Conveyancing Searches</span></strong></p>
<p><span style="color: #000000;">Searches are carries out to unearth any potential issues that might affect the property. These include local authority searches, environmental searches, and water and drainage searches. They provide valuable information about the property and may give rise to further questions that need to be raised with the sellers.</span></p>
<p><strong><span style="color: #000000;">Step 4: Surveys and Valuations</span></strong></p>
<p><span style="color: #000000;">Property surveys and valuations are crucial to help understand the property’s condition and market value, and to help identify any hidden issues. You will be advised to commission a survey. Once you receive the report, you conveyancer will review the section regarding the legal implications and make any relevant further enquiries.</span></p>
<p><strong><span style="color: #000000;">Step 5: Enquiries</span></strong></p>
<p><span style="color: #000000;">Your conveyancer will raise enquiries with the seller’s conveyancer regarding the property, and the seller’s solicitor will provide responses. Your conveyancer will then report to you to ensure that you fully understand all of the aspects and quirks of the property you are buying.</span></p>
<p><strong><span style="color: #000000;">Step 6: Signing the Contract and Transfer Deed</span></strong></p>
<p><span style="color: #000000;">Once you are satisfied with the property and the contract terms, you will sign the physical Contract and Transfer Deed in preparation for Exchange of Contacts. Your agreement to purchase the property is not yet legally binding and either party can still withdraw from the purchase at any time. Contracts only become legally binding once they have been exchanged (see step 7). &nbsp;You will also agree a date for completion at this time.</span></p>
<p><strong><span style="color: #000000;">Step 7: Exchange of Contract</span></strong></p>
<p><span style="color: #000000;">After both parties have signed their copies of the Contract and Transfer Deed, your conveyancer will exchange contracts with the seller’s conveyancer. This step makes the agreement legally binding. It is at this stage that the deposit becomes payable. The standard deposit is 10% of the purchase price, and it is usually transferred to the seller’s conveyancer to hold until legal completion has taken place (usually a week or two after exchange of contracts).</span></p>
<p><span style="color: #000000;">You commit to purchase the property in the condition it is in at the time that the contracts are exchanged. It is therefore wise to arrange to inspect the property on the morning of the proposed exchange date to ensure that no damage has been inflicted on the property since the last time you viewed it.</span></p>
<p><span style="color: #000000;">Once contracts have been exchanged, you must complete the purchase even if the property is damaged between the date that contracts are exchanged and the date that legal completion takes place. You should therefore put buildings insurance in place from the date of exchange of contracts.</span></p>
<p><span style="color: #000000;">If you do not complete the purchase on the agreed completion date, you will forfeit your 10% deposit and the seller may rescind the contract and remarket the property.</span></p>
<p><strong><span style="color: #000000;">Step 8: Title Transfer</span></strong></p>
<p><span style="color: #000000;">On the agreed-upon completion date, the legal ownership of the property will be transferred from the seller to you. Your conveyancer will oversee this process to ensure that it occurs smoothly and in compliance with all legal requirements. It is at this point that the balance of the purchase price is transferred to the seller’s conveyancer.</span></p>
<p><strong><span style="color: #000000;">Step 9: Stamp Duty Land Tax</span></strong></p>
<p><span style="color: #000000;">Your conveyancing solicitor will then handle the payment of Stamp Duty Land Tax on your behalf to ensure that it’s accurately calculated, the tax return is correctly completed, and the tax is paid to HM Revenue and Customs.</span></p>
<p><strong><span style="color: #000000;">Step 10: Land Registry</span></strong></p>
<p><span style="color: #000000;">The final step involves registering you as the new owner of the property at the Land Registry. This ensures that your legal ownership is officially recorded. Your conveyancer will help handle the registration.</span></p>

<p><span style="color: #000000;">It’s a significant step for you and your partner to make the exciting decision to buy a property and create a shared space where you can build your lives together. In previous articles, we discussed the property investment considerations for cohabiting couples. When considering the financial benefits of buying a property together, the legal aspects are essential to consider as well, especially where couples are cohabiting but are not married. What legal considerations should you keep in mind when purchasing a home as a cohabiting couple?</span></p>
<ol>
<li><strong><span style="color: #000000;">Legal Ownership</span></strong><br /><span style="color: #000000;"> Determine how the property will be legally held, either as joint tenants, or tenants in common. Joint tenancy means both partners own the property jointly, with no distinguishable share, while tenants-in-common have a defined share of the property. This share could be equal (50:50) or in unequal percentages. Joint tenants cannot pass their interest in the property through their Will, but tenants-in-common can.</span></li>

<li><strong><span style="color: #000000;">Mortgage Arrangements</span></strong><br /><span style="color: #000000;"> How is the mortgage to be discharged monthly? Is each person paying an equal amount or is this to be paid in unequal shares? If the split is unequal, is this fair or appropriate? Should the person paying a larger portion of the outgoings be entitled to a larger portion of the equity in the property in compensation?</span></li>
</ol><ol start="3">
<li><strong><span style="color: #000000;">Tax Implications</span></strong><br /><span style="color: #000000;"> Getting specialist financial advice on the impact of buying a property and any tax considerations is important. Will you need to pay the higher rate of Stamp Duty? Will your estate be liable to Inheritance Tax when you die? Will any Capital Gains Tax be payable when you sell the property?</span></li>
</ol><ol start="4">
<li><strong><span style="color: #000000;">Financial Contributions</span></strong><br /><span style="color: #000000;"> Define clearly both partners’ contributions and how the expenses are to be shared. As set out above, where expenses are not shared equally, is it agreed that the person who is contributing more should be compensated in the percentage of property ownership? Entering into a Cohabitation Agreement can help reduce any conflict or dispute in the future.</span></li>

<li><strong><span style="color: #000000;">Exit Strategy</span></strong><br /><span style="color: #000000;"> No one likes to think about the end, but it’s crucial. Consider what happens to the property if the relationship ends or, if one partner passes away. A legal document like a Will or a Cohabitation Agreement can provide clarity, and particularly where you are not married, ensure that each person’s interests are protected.</span></li>

For cohabiting couples, there is no inherent right of occupation and this means that on separation, if you do not have an established interest in the property in which you live, you could legally be excluded from the place you consider home with little to no notice. The position generally in relation to cohabiting couples is therefore more complex than married couples and so it is often wise for them to clearly, and legally, set out their rights and obligations.</span></li>
